Washington, February 14 — The U.S. International Trade Commission (ITC) has ruled that Chinese solar cells are causing "substantial injury" to the U.S. domestic industry, paving the way for the U.S. Department of Commerce to continue its ongoing "double-countervailing" investigation into imports from China. This decision marks another step in a long-standing trade dispute between the two countries over solar technology. The ITC announced on the same day that four of its five members voted unanimously in favor of the finding, while the fifth member did not participate in the case. Under U.S. trade law, this preliminary ruling triggers further investigations by the Department of Commerce, which is expected to issue preliminary findings on anti-dumping and countervailing duties in March and June respectively. The case against Chinese solar products began in December 2022, when Solar World Americas, the U.S. arm of the German solar company Solar World, filed a complaint seeking an investigation into alleged unfair trade practices. In 2011, China exported over $3.1 billion worth of solar panels to the U.S., but that figure dropped to $2.1 billion in 2012. The recent filing by Solar World has raised concerns among Chinese manufacturers and officials. In January 2024, the U.S. Department of Commerce officially launched the "double-reverse" investigation, with Solar World’s U.S. branch proposing a dumping margin as high as 165.04% and a subsidy rate exceeding 2%. This is the second time since 2011 that the U.S. has initiated such an investigation against Chinese solar imports. In 2012, the U.S. imposed anti-dumping duties ranging from 18.32% to 249.96%, and countervailing duties between 14.78% and 15.97%. China’s Ministry of Commerce has expressed serious concerns over the latest developments, arguing that previous measures have not improved the U.S. solar industry's competitiveness but instead triggered a global supply chain disruption. It emphasized that the Sino-U.S. photovoltaic sector is highly integrated and holds significant potential for collaboration. The ministry urged the U.S. to handle the matter cautiously and avoid escalating trade tensions. It also warned that China will closely monitor the case and take all necessary steps to protect its interests and ensure fair trade practices. As the investigation moves forward, both sides are under pressure to find a balanced solution that supports sustainable growth in the clean energy sector.
