The Labor (Personnel and Labor) Offices and Quality Supervision and Inspection Agencies for Labor Protection Products in all provinces, autonomous regions, and municipalities directly under the Central Government are hereby informed that to ensure the quality of production licenses for labor protection products and enhance the management system, the "Interim Measures for the Administration of Examiners of Labor Protection Product Production Licenses" has been formulated. These measures are now issued for your implementation. The number of examiners to be appointed should be determined based on the needs of license reviews in each region, and applications for examiner appointments must be submitted to the Ministry of Labor’s Office of Labor Protection Product Production Licenses by the end of July 1995. Please report any issues encountered during the implementation of these measures promptly.

Attachment: Interim Measures for the Administration of Examiners of Labor Protection Product Production Licenses

Article 1: These measures are established to strengthen the management of examiners of labor protection product production licenses, improve the professional standards of examiners, and ensure the quality of certification examinations.

Article 2: An "examiner" refers to staff members of the labor department who evaluate the conditions for obtaining or replacing labor protection product production licenses.

Article 3: Examiners shall be trained, assessed, and appointed by the Office of Labor Protection Product Production Licenses under the Ministry of Labor.

Article 4: To qualify as an examiner, individuals must meet the following requirements:

  • Be familiar with national laws, regulations, policies, and standards related to product quality supervision and labor protection products;
  • Understand the rules for industrial product production licenses and labor protection product production licenses, and be able to conduct thorough reviews in accordance with the "Implementation Rules for Production Licenses for Labor Protection Products";
  • Have knowledge of quality management, quality assurance, and relevant national standards;
  • Be well-versed in labor protection product standards, inspection procedures, and production techniques;
  • Adhere strictly to work discipline and perform due diligence in reviewing production license applications.

Article 5: Personnel working in labor protection product quality supervision institutions at or above the county level who meet the examiner criteria may be appointed as examiners.

Article 6: To apply for examiner status, applicants must submit a formal application. After approval from the provincial labor authority, they should complete the examiner application form (see Attachment 1) and submit it to the Ministry of Labor’s Office of Labor Protection Product Production Licenses. Following training and assessment, the Ministry will appoint them as examiners.

Article 7: Appointed examiners will receive a "Qualification Certificate for the Production License of Labor Protection Products of the Ministry of Labor." If an examiner leaves their position, the certificate will be revoked by the Ministry’s Office of Production Licenses.

Article 8: Examiners must:

  • Implement national laws, regulations, and standards related to product quality and production licenses;
  • Participate in license review processes and fulfill tasks assigned by the Ministry;
  • Report findings and management issues to the relevant authorities;
  • Have the right to challenge falsification or illegal acts during the review process and request corrections.

Article 9: Examiners must continuously improve their skills through training and study every three years.

Article 10: Examiners must not engage in paid consultations or activities that could compromise impartiality.

Article 11: Examiners must maintain confidentiality of technical data and information related to enterprises under review.

Article 12: Examiners must follow the "Code for Issuing Production License Personnel."

Article 13: Outstanding examiners may be rewarded by the Ministry or relevant departments for their contributions.

Article 14: Violations of these measures may result in removal from the examiner role and revocation of the qualification certificate. Serious cases may lead to administrative penalties.

Article 15: At least three examiners must be present during the review of a company's production license application, and they must carry valid identification.

Article 16: Labor departments must manage examiners effectively and ensure team stability.

Article 17: These measures take effect from the date of promulgation.
