The Labor (Personnel and Labor) Offices and Quality Supervision and Inspection Agencies in all provinces, autonomous regions, and municipalities directly under the Central Government are hereby notified. In order to ensure the quality of labor protection product production licenses and improve the management system, the "Interim Measures for the Administration of Examiners of Labor Protection Product Production Licenses" has been formulated. These measures are now issued for implementation. The number of examiners should be determined based on regional needs, and applications must be submitted to the Ministry of Labor before the end of July 1995. Any issues encountered during implementation should be reported promptly.

Attachment: Interim Measures for the Administration of Examiners of Labor Protection Product Production Licenses

Article 1: These measures are established to strengthen the management of labor protection product production license examiners, enhance their professional capabilities, and ensure the quality of certification processes.

Article 2: An examiner refers to staff members from the labor department who review the conditions for obtaining or replacing labor protection product production licenses.

Article 3: Examiners must be trained, assessed, and appointed by the Office of the Ministry of Labor for Labor Protection Product Production Licenses.

Article 4: Examiners must meet the following criteria:

  • Understand national laws, regulations, policies, and standards related to product quality and labor protection products;
  • Be familiar with industrial product and labor protection product licensing procedures and capable of conducting strict reviews;
  • Master basic knowledge of quality management, assurance, and supervision, and comply with relevant standards;
  • Know the standards, detailed rules, and technical requirements for labor protection products;
  • Adhere to work discipline and perform due diligence during the review process.

Article 5: Personnel working in labor protection product quality supervision institutions at or above the county level, who meet the examiner qualifications, may be appointed as examiners.

Article 6: To apply, individuals must submit an application form (see Attachment 1), obtain approval from the provincial labor authority, and submit it to the Ministry of Labor's Office of Labor Protection Product Production Licenses. After training and assessment, they will be appointed by the office.

Article 7: Qualified examiners will receive a "Qualification Certificate for the Production License of Labor Protection Products of the Ministry of Labor." If an examiner leaves their position, the certificate will be revoked.

Article 8: Examiners must:

  • Implement relevant laws, regulations, and standards;
  • Participate in license review processes and complete assigned tasks;
  • Report findings to higher authorities;
  • Have the right to challenge falsification or illegal acts during the review process.

Article 9: Examiners should continuously improve their skills through training every three years.

Article 10: Examiners must not engage in activities that compromise impartiality, such as research, production, or paid consultations related to labor protection products.

Article 11: Examiners must protect confidential information about enterprises under review and avoid any disclosure.

Article 12: Examiners must follow the "Code for Issuing Production License Personnel."

Article 13: Those who make outstanding contributions may be rewarded by the Ministry of Labor or relevant departments.

Article 14: Violations of these measures may result in dismissal, revocation of the examiner’s certificate, or administrative penalties.

Article 15: At least three examiners must be present during the review of production license applications.

Article 16: Labor authorities should manage examiners effectively and maintain team stability.

Article 17: These measures take effect from the date of promulgation.
